The existing NPDC Bylaws, the Public Places Bylaw (Part 5), the Signs Bylaw (Part 7) and the Trading in Public Places (Licensing of Street Traders) Bylaw (Part 12) are due for review. It is proposed to replace these three bylaw parts with a new single stand-alone Activities in Public Places Bylaw (the Draft Bylaw).

The Draft Bylaw rolls over many of the existing provisions and regulations in the three reviewed bylaws. There are also several minor updates proposed in the Draft Bylaw to improve clarity, align to current processes and procedures, and are consistent with good practice bylaws. This includes minor changes related to drones, busking, mobile traders with respect to food registration licenses, and the ability for Council to remove or alter unsafe signs.

The purpose of the Draft Bylaw is:

  1. for public places to:
    • protect the public from nuisance; and
    • protect, promote and maintain public health and safety; and
    • minimise the potential for offensive behaviour;
  2. to manage and protect Council-owned or controlled land, structures and other property and assets under Council control from misuse, damage or loss;
  3. to ensure that any signs on any public place are erected and maintained in such a manner that they do not present a hazard or danger to the public and regulate the type and location of advertising signs on parks and reserves or other public places; and
  4. to regulate trading in public places.
